Terms of Service

Last updated: [DATE]

1. Acceptance of these terms

By purchasing or opening a SnowGlobeGo gift, you agree to these Terms of Service. If you do not agree, do not use the service.

2. What SnowGlobeGo is

SnowGlobeGo lets a sender create a personalized, live 3D digital snow globe — choosing who it is for and a figure, and adding an optional photo, a short message, and an optional 15-second voice note — and deliver it to a recipient as a link. No account, app download, or signup is required for either sender or recipient.

3. Eligibility

You must be an adult (or have reached the age of majority in your jurisdiction) to purchase a gift, consistent with our payment provider's requirements. SnowGlobeGo is not directed at children.

4. Content you submit

You retain ownership of the photo, message, and voice note you submit. By submitting them, you grant SnowGlobeGo a license to host, store, transmit, and display that content solely to deliver your gift to the intended recipient. You confirm that you have the right to share the content you upload and that it does not violate any law or third party's rights.

Prohibited content includes anything illegal, infringing, harassing, or unsafe. Uploaded photos are automatically screened before a gift becomes viewable (see our Privacy Policy). Any gift can be reported via the "Report this gift" link shown on its page; we will review reports and may remove content found to violate these terms, consistent with our obligations under the EU Digital Services Act.

Voice notes

See our Privacy Policy for how voice recordings are handled, including that this feature is currently unavailable to senders located in Illinois, Texas, or Washington (United States), pending legal review.

5. How the single-recipient gift works

Each gift can be claimed by only one recipient: whoever first taps the "Open your gift" button on the link owns it, with no way to reverse or reassign it afterward. If you share the link before the intended recipient opens it, whoever opens it first becomes the owner. If the recipient's device or browser data is lost, the gift cannot be recovered.

You may edit a sent gift until one hour has passed or the recipient opens it, whichever happens first — after that, edits are no longer possible (the recipient's home-screen icon is generated at the moment they add it and does not update later).

Save your sender links when you receive them — we cannot retrieve them for you afterward.

6. Payment, pricing, and refunds

Payment is processed by Stripe. Prices are shown in your local currency and may vary by region (we use up to three regional pricing tiers). We do not offer discounts, coupons, or bundle pricing at this time. Where required, prices shown in the EU include VAT.

Right of withdrawal for digital content

Before completing payment, you will be asked to confirm:

"I consent to the immediate delivery of digital content and acknowledge that I thereby lose my right of withdrawal from the contract."

By checking this box, you agree that your gift is delivered immediately upon payment and that you waive your statutory right of withdrawal for digital content, to the extent permitted by applicable law. This does not limit your right to dispute a charge with your bank or card issuer.

See our separate Refund and Withdrawal Policy for further detail.

7. Anonymous ("Secret admirer") gifts

You may choose to hide your name from the recipient. This does not make you anonymous to SnowGlobeGo — see our Privacy Policy.

8. Service availability

SnowGlobeGo is hosted on Vercel infrastructure. We aim to keep gift links working indefinitely but do not guarantee uninterrupted availability and are not liable for delivery failures caused by the recipient's device, browser, or in-app browser limitations (e.g., WhatsApp or Instagram's built-in browsers not supporting "Add to Home Screen").

9. Disclaimers and limitation of liability

The service is provided "as is." To the maximum extent permitted by law, SnowGlobeGo is not liable for indirect, incidental, or consequential damages arising from your use of the service. [Governing-law-specific liability caps to be finalized with counsel once the operating entity is established.]

10. Termination and content removal

We may remove any gift that violates these terms, in response to a valid report, or in connection with a payment dispute or chargeback.

11. Governing law

[Placeholder — to be finalized once the Stripe Atlas entity is incorporated and its jurisdiction (likely Delaware, USA) is confirmed.]

12. Changes to these terms

We may update these terms as the product evolves. Material changes will be reflected by updating the "Last updated" date above.
